Are Smoking or Trading in Tobacco Permissible?

Q What is the ruling on smoking tobacco? What is the ruling on trading in tobacco?

Answer

In the Name of Allah, Most Gracious, Most Merciful. 

All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.


In this fatwa:

Smoking and trading in tobacco are prohibited.


In responding to this question, the European Council for Fatwa and Research, states:

Undoubtedly, it has been proven that smoking is the cause of many fateful diseases. Health organizations across the world warn against smoking and its ill-effects.

Most of the countries are taking steps to limit smoking, its consumption and the tobacco trade.

Moreover, it has been proved that its harm is not limited to smokers. It affects others known as passive smokers. Smoking is bad and impure. Allah said describing Prophet Muhammad: {He allows them as lawful what is good (and pure) and prohibits them from what is bad (and impure).} (Al-A`raf 7:157)
It is consensually stated that whatever causes harm is prohibited. In addition, it is a waste of money which is forbidden too.

Moreover, smoking enslaves the smokers. Taking into consideration the significance and the fundamental rules of the Shari’ah, the European Council for Fatwa and Research (ECFR) stresses that smoking and trading in tobacco are prohibited according to the legal maxims: “There shall be no harm, nor any reciprocation of harm” and “Harm is to be removed.”
