Answer
In the Name of Allah, Most Gracious, Most Merciful.
All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.
In this fatwa:
Denying the bonus does not give you a license to steal from the company’s money.
In his response to your question, Prof. Dr. Monzer Kahf, Professor of Islamic Finance and Economics at Qatar Faculty of Islamic Studies, states:
The bonus by definition is a gift not a right. Denying the bonus does not give you a license to steel from the company’s money. Furthermore, even if your salary is not paid (and this is definitely your right) you cannot take company’s money on your own, this is pure theft.
You must protect company’s money and hand it to the appropriate person(s) according to the system. You can ask for your right and you may sue the company in court for it.
But not paying your right or your gift does not give you a license to steal.
Almighty Allah knows best.
